What your state requires of ABA employers
Harassment-prevention training is one of the few trainings the law makes an employer repeat on a clock. Here's the rule in five states and New York City, each cited to the law or agency we read it in.
- California. If you employ five or more people, California requires two hours of harassment-prevention training for every supervisor and one hour for every other employee, repeated every two years, with new employees trained within six months of hire or promotion. California also requires that online training give learners a way to reach a trainer who answers their questions within two business days, and that you keep the training records for two years. (Cal. Gov. Code §12950.1; 2 CCR §11024)
- New York. New York requires every employer to provide interactive harassment-prevention training to every employee every year. There is no minimum size. New York's own guidance is explicit that a video alone is not interactive: learners must be asked questions, be able to ask questions and get answers, or give feedback. (NY Lab. Law §201-g; NYS model policy and training guidance)
- New York City. On top of the state rule, New York City employers with 15 or more employees must keep training records for three years. (NYC Commission on Human Rights)
- Illinois. Illinois requires every employer, of any size, to provide harassment-prevention training to all employees once a year. (775 ILCS 5/2-109)
- Delaware. Employers with 50 or more employees in Delaware must provide interactive harassment-prevention training to every employee within one year of hire and every two years after that, with additional training for supervisors on the same schedule. (19 Del. C. §711A)
- Maine. Employers with 15 or more employees must train every new employee within one year of hire, give supervisors additional training on their own responsibilities, and keep the training records for three years. (26 M.R.S. §807)
Most states do not require harassment-prevention training from private employers. Training still matters everywhere: the EEOC recommends it, and having trained your staff is what an employer points to when a complaint is made.
What our training covers
Special Learning's harassment-prevention training was written for ABA agencies, not adapted from an office course. It comes in a staff version and a supervisor version, and every scenario happens where your people actually work: a session room with one other adult, a family's kitchen table, a school hallway. It covers the topics California names: the legal definition of sexual harassment and abusive conduct, harassment based on gender identity, gender expression and sexual orientation, practical examples, how to report and what protects the person who reports, the remedies available under state and federal law, and, for supervisors, what to do the moment someone tells you something. California also asks that e-learning give the learner a way to reach a qualified trainer who answers within two business days.
